1. Introduction

Welcome to GPT Image. By accessing or using our website and any related services at gptimage.ai (“Service”), you agree to these Terms of Service (“Terms”). If you disagree with any part of the Terms, please do not use the Service.

2. Service Description

GPT Image provides AI-powered image generation and related features that convert user-supplied text prompts and/or reference images into synthetic images using OpenAI’s GPT-4o model and other technologies. We offer:

  • Free trial – limited number of image generations at no cost.
  • Subscription plans – optional paid tiers that unlock higher usage limits and additional features.

We may change or discontinue features at any time without prior notice.

3. User Obligations

By using the Service, you agree to:

  1. Comply with all applicable laws and regulations.
  2. Not attempt to interfere with, disrupt, or reverse-engineer the Service.
  3. Not use the Service for unlawful, harmful, or infringing purposes.
  4. Not generate content that is hateful, discriminatory, abusive, sexually explicit, or violates intellectual-property rights.

4. Intellectual Property & Licensing

  • Your prompts & uploads remain yours; you grant us a temporary licence to process them solely to provide the Service.
  • Generated images are provided under the Creative Commons Zero (CC0) licence—meaning you may use them for any purpose, including commercial use, without attribution.
  • GPT Image retains all rights to the underlying software, models, and branding. These may not be copied, modified, or redistributed without permission.

Third-party rights: Certain prompts could produce content that incidentally includes or resembles material protected by others. You are responsible for ensuring your prompts do not infringe third-party rights.

5. Privacy

Our practices are described in the GPT Image Privacy Policy (last updated July 15, 2025). By using the Service you acknowledge that policy.

6. Content Moderation and Reporting

All prompts and uploads are automatically scanned for sensitive keywords and policy violations before generation. Users may flag any generated image using the “Report” button; reported items enter our moderation queue for administrator review. Repeated or severe violations may result in content removal or account suspension.

7. Deletion and Data Retention

  • You can delete any image (uploaded or generated) at any time via the “Clear My Images” button in your gallery.
  • If you do not proactively delete your uploads or generations, all images are automatically purged from our servers within 24 hours of creation.

8. Service Availability

We aim for uninterrupted service but do not guarantee it. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

9. Content Guidelines

You agree not to generate or share content that:

  • Violates any law or regulation
  • Contains hate speech, violence, or harassment
  • Infringes intellectual-property or privacy rights
  • Is sexually explicit or pornographic
  • Promotes self-harm, terrorism, or other illegal activity

We may block or remove content that breaches these guidelines.

10. Limitation of Liability

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, GPT Image shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of—or inability to use—the Service.

11. Regional Payment Exceptions

Once our new checkout launches, payments from customers whose billing country, IP address, or issuing-bank country is identified as Russia or Belarus will not be routed through our primary merchant-of-record service (Creem) because of continuing international card-network restrictions and sanctions. If and when our WebMoney integration is approved, those customers will be invited to complete purchases exclusively through WebMoney or another compliant local wallet.

Until such an option is available, residents of Russia and Belarus will be unable to place paid orders. GPT Image (Shenzhen, PRC) will act as the merchant of record for any future WebMoney transactions and will assume responsibility for local VAT, refunds and customer support. Attempts by Russian or Belarusian users to pay via Creem-powered checkouts will be automatically blocked or refunded.

12. Refunds & Cancellation

  • Self-service cancellation – You may cancel your active subscription at any time in Membership Account › My Memberships › Cancel. The cancellation will prevent the next renewal charge and you may continue to use paid features until the current billing cycle ends.
  • Immediate cancellation & refund – If you wish to reverse a subscription charge immediately after purchase, please email [email protected] within 24 hours. Our team will void or refund that transaction in accordance with card-network rules.
  • Refund window – You may request a refund within 7 calendar days of the original charge. We will deduct the monetary value of any generation credits you have already used and refund the unused portion to the original payment method. After 7 days, payments are non-refundable unless required by applicable law. EU/UK consumers retain the 14-day statutory right of withdrawal for digital content unless they expressly waive it by starting to use the service immediately.

13. Changes to Terms

We may update these Terms at any time. Material changes will be posted here with a new “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
